Use of the Application
Deal Centre provides a web-based application for real estate transaction management. The Application is a tool only and does not replace legal, accounting, tax, payroll, or regulatory advice. Subscribers remain fully responsible for compliance with all applicable laws, regulations, and professional obligations.
Data, Storage and Retention
Subscribers are responsible for maintaining copies of their own uploaded content and data. Deal Centre does not provide backup or recovery services. Upon termination or discontinuation, Subscribers will have a three (3) month period to access, view, and download their content, after which it may be permanently deleted.
Security and Account Responsibility
Subscribers must maintain the confidentiality of login credentials and are responsible for all activity under their account, including activity by employees, agents, contractors, and other authorized users.
Intellectual Property
All intellectual property rights in Deal Centre, including software, trademarks, documentation, content, outputs, and underlying concepts, remain the exclusive property of Deal Centre. The Application may not be copied, reverse engineered, resold, or used to build a competing product or service.
Service Availability and Liability
The Application is provided on an as-is and as-available basis. Deal Centre does not guarantee uninterrupted availability, error-free operation, or that the Application will meet every requirement or expectation. Liability is limited to the fees paid in the three (3) months preceding the event giving rise to the claim.
Indemnification and Compliance
Subscribers agree to indemnify Deal Centre for claims, damages, losses, expenses, regulatory actions, fines, penalties, and security incidents arising from misuse of the Application, violation of applicable law, breach of the Terms, or unauthorized access connected to Subscriber credentials or systems.
Data Processing and Privacy
Deal Centre may process and use data as necessary to provide, maintain, support, and improve the Application in accordance with the Software Service Agreement and Privacy Policy. Aggregated and anonymized data may be used for analytics and product improvement, provided it does not identify a Subscriber or individual.
